                                                                                What’s the IDEA?

By Shelly Hendricksen

What is the Individuals with Disabilities Education Act (IDEA)(2004)? How does it help my child?

The Utah Council of the Blind (UCB) is going to provide a series of articles that will focus on different aspects of the laws that are designed to help our children in school. This first article is explaining what the IDEA (2004) is.

The Individuals with Disabilities Education Act (IDEA) (2004) was originally named the Education of All Handicapped Children Act of 1975.

The IDEA is a piece of legislation that allows all students with a disability a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE). We will discuss the LRE in a future article.

There are 4 major sections of the IDEA. The first two are designed to clarify the law and to provide an individualized system of support for every disabled child who qualifies. There are 13 different qualifying disability categories:

ASD: Autism Spectrum Disorders

Deaf/Blindness

Deafness

Emotional Disturbance

Hearing Impairment

Intellectual Disability

Multiple disabilities

Orthopedic Impairment

Other Health Impairment:

Specific Learning Disability (SLD)

Speech or language Impairment

Traumatic Brain Injury (TBI)

Visual Impairment including Blindness

Under these 13 categories are specific requirements for individuals to meet in order to qualify for an Individualized Education Program (IEP).

An IEP is a federally-written document. In next month’s issue we will discuss what an IEP is and what the process is to see if a child qualifies for one.
